Christmas 6-Month Promotional Membership Agreement (2025-2026)

(This agreement sets out the full Terms and Conditions for the Active Mid Devon Christmas 6‑Month Promotional Membership, available between 15 December 2025 and 31 January 2026. It must be read in conjunction with any relevant policies of Mid Devon District Council and replaces all previous promotional membership terms for the duration of this offer.)

Promotion overview

This special offer provides a 6‑month All‑Inclusive minimum-term agreement membership at a promotional rate, available only during the Christmas season. The promotion runs from 15th December 2025 to 31st January 2026 and is open for online purchase only.

Eligibility

• New Members: Open to individuals who are not currently members of Active Mid Devon.
• Current Members: May opt into the promotion by providing 30 days’ notice to cancel their existing membership before joining the 6‑month minimum-term agreement.
• This promotion cannot be combined with other discounts or offers.

Membership details

• Agreement Length: 6 months from the date of activation.
• Commitment: Members agree to remain enrolled for the full 6-month term.

Duration and renewal

The membership runs for a minimum term of six (6) consecutive months from the activation date. At the end of the 6‑month term, members may:

• Cancel with no further obligation by giving 30 days’ notice.
• Memberships renew automatically on the renewal date unless cancelled in advance. If you do not cancel or change your membership type 30 days before the renewal date, the standard rate will be charged automatically using the payment method on file.

Membership benefits

Members will have access to:

• Gym facilities during normal opening hours;
• Public swimming sessions;
• Group exercise classes (subject to availability);
• 8 day booking privilege for online booking via the Active Mid Devon app or website.

Payment terms

• Monthly instalments are collected by Direct Debit according to the agreed schedule.
• The first payment will be prorated depending on the join date.
• The promotional rate is £35.00 per month (standard rate £41.00 per month).
• No refunds will be issued for unused time within the contract period.
• Members will receive at least 14 days’ notice of any fee changes in accordance with the Payment Services Regulations 2017.

Cooling-off period

Members who join online, by telephone or in person have the right to cancel within 14 days of the activation date without penalty. If any services are used during this period, a proportionate deduction will be made from the refund for those services.

Early termination and cancellation

Cancellations within the 6‑month term are permitted only for the following reasons:

• Medical reasons supported by evidence;
• Relocation outside a 25‑mile radius;
• Redundancy or financial hardship (with documentation);
• Prolonged illness or pregnancy.

If a member chooses to cancel early for other reasons, an Early Termination Fee applies. The member must pay the difference between the full monthly rate (£41.00) and the promotional rate (£35.00) for each month remaining on the contract.
After the 6‑month term, members may cancel at any time by giving 30 days’ written notice.

Liability

Nothing in this agreement limits or excludes the Council’s liability for death or personal injury caused by negligence. Members use the facilities at their own risk only to the extent permitted by law. The Council accepts responsibility for personal injury or death caused by its negligence or that of its employees or contractors.

Data protection and marketing

The Council processes personal data in accordance with the Data Protection Act 2018 and UK GDPR. If additional data are collected as part of this promotion, a lawful basis such as consent will be established. Marketing communications will comply with the Privacy and Electronic Communications Regulations 2003, and members may opt out at any time.

Member responsibilities

Members must comply with all centre rules, health and safety requirements, and reasonable staff instructions. Abusive behaviour or misuse of facilities may result in suspension or termination without refund.

Agreement acceptance

By reading and ticking the box the member confirms that they have read, understood, and agree to these Terms and Conditions, including the six‑month minimum commitment, cooling‑off rights, and early termination provisions.
